Charter Party Bill of Lading
চার্টার পার্টি বিল অব ল্যাডিং
a. A bill of lading, however named, containing an indication that it is subject to a charter party (charter party bill of lading), must appear to: [যে নামেই ডাকা হোক না কেন, যদি Bill of Lading-এ উল্লেখ থাকে যে এটি charter party-এর অধীনে, তখন এই Charter Party Bill of Lading-এ নিম্নোক্ত বিষয়গুলো থাকা বাধ্যতামূলক:]
i. be signed by: [harter Party Bill of Lading- নিচের নিয়মানুযায়ী স্বাক্ষরিত হতে হবে:]

the master or a named agent for or on behalf of the master, or
[Master নিজে বা Master-এর পক্ষে বা তার হয়ে কোনো নির্দিষ্ট Agent দ্বারা; অথবা] -
the owner or a named agent for or on behalf of the owner, or
[Owner নিজে বা Owner-এর পক্ষে বা তার হয়ে কোনো Agent দ্বারা; অথবা] -
the charterer or a named agent for or on behalf of the charterer.
[Charterer নিজে বা Charterer-এর পক্ষে বা তার হয়ে কোনো Agent দ্বারা।]
Any signature by the master, owner, charterer or agent must be identified as that of the master, owner, charterer or agent. [ Charter Party Bill of Lading- এ Master, Owner, Charterer বা Agent—যেই স্বাক্ষর করুক না কেন, সেখানে স্পষ্টভাবে উল্লেখ থাকতে হবে যে এটি Master, Owner, Charterer বা Agent-এর স্বাক্ষর।]
Any signature by an agent must indicate whether the agent has signed for or on behalf of the master, owner or charterer. [Charter Party Bill of Lading- এ যদি কোনো Agent স্বাক্ষর করে, তবে স্পষ্টভাবে উল্লেখ করতে হবে যে সে Master, Owner বা Charterer-কার পক্ষে স্বাক্ষর করেছে।]
An agent signing for or on behalf of the owner or charterer must indicate the name of the owner or charterer. [যদি Owner বা Charterer-এর পক্ষে কোনো Agent স্বাক্ষর করে, তাহলে Owner বা Charterer-এর নামও উল্লেখ থাকতে হবে।]
ii. indicate that the goods have been shipped on board a named vessel at the port of loading stated in the credit by:
[এতে উল্লেখ থাকতে হবে যে পণ্য LC-তে উল্লেখিত পোর্ট অব লোডিং (বন্দরে) নির্দিষ্ট জাহাজে তোলা (shipped on board ) হয়েছে। এটা লেখা থাকতে পারে. . . ]

pre-printed wording, or

an on board notation indicating the date on which the goods have been shipped on board. [একটি “on board” নোটেশনের মাধ্যমে, যেখানে পণ্য জাহাজে তোলা(shipped on board)র তারিখ উল্লেখ থাকবে।]
The date of issuance of the charter party bill of lading will be deemed to be the date of shipment unless the charter party bill of lading contains an on board notation indicating the date of shipment, in which case the date stated in the on board notation will be deemed to be the date of shipment.
[Charter Party Bill of Lading-এ on board notation দ্বারা shipment date উল্লেখ করা না থাকে, তবে Charter Party Bill of Lading -এর issue date-কে shipment date হিসেবে ধরা হবে। যদি on board notation থাকে, তাহলে সেখানে সেই তারিখই shipment date হিসেবে গণ্য হবে।]
iii. indicate shipment from the port of loading to the port of discharge stated in the credit. The port of discharge may also be shown as a range of ports or a geographical area, as stated in the credit.

iv. be the sole original charter party bill of lading or, if issued in more than one original, be the full set as indicated on the charter party bill of lading.
[original Charter Party Bill of Lading এর একটি মাত্র অরিজিনাল ইস্যু হতে পারে; অথবা একাধিক অরিজিনালও ইস্যু করা হতে পারে, সেক্ষেত্রে ডকুমেন্ট বলতে পুরো সেটটিকে বোঝাবে।]
b. A bank will not examine charter party contracts, even if they are required to be presented by the terms of the credit.
[Bank Charter Party contract পরীক্ষা করবে না, এমনকি যদি LC-এর শর্তে তা উপস্থাপন করা বাধ্যতামূলক বলাও হয়।]

1️⃣ Signature:

Master / Owner / Charterer অথবা তাদের Agent স্বাক্ষর করতে পারে।

Agent স্বাক্ষর করলে স্পষ্টভাবে উল্লেখ করতে হবে, কার পক্ষে স্বাক্ষর করছে।

Owner/Charterer-এর পক্ষে Agent স্বাক্ষর করলে নামও উল্লেখ থাকতে হবে।
2️⃣ On board notation & shipment date:

On board notation থাকলে তারিখ → shipment date
-
On board notation না থাকলে → issue date → shipment date
3️⃣ Port of discharge: LC-তে range of ports বা geographical area হিসেবে উল্লেখ করা যেতে পারে।
4️⃣ Full set requirement: একাধিক original হলে full set জমা দিতে হবে।
5️⃣ Charter party contracts: Bank পরীক্ষা করবে না।
6️⃣ Transshipment: Explicit transshipment rule নেই (commercial contract অনুযায়ী)।
7️⃣ Shortcut: Article 22 ≠ Article 20/21 → document negotiable নয়, charter party-এর অধীনে, signature authority Master/Owner/Charterer, Port of discharge flexible।
