Transport Document Covering at Least Two Different Modes of Transport
কমপক্ষে দুই ধরনের পরিবহন ব্যবস্থার আওতাভুক্ত পরিবহন দলিল
a. A transport document covering at least two different modes of transport (multimodal or combined transport document), however named, must appear to: [ কমপক্ষে দুই ধরনের পরিবহন ব্যবস্থা সম্বলিত একটি পরিবহন দলিল (Multimodal বা Combined Transport Document), যে নামেই তাকে ডাকা হোক না কেন, এতে নিম্নলিখিত বিষয়গুলো থাকতে হবে:
i. indicate the name of the carrier and be signed by: [ এতে পরিবহনকারীর (Carrier) নাম উল্লেখ থাকতে হবে এবং এটি [নিচের বর্ননা মোতাবেক] স্বাক্ষরিত হতে হবে—
- the carrier or a named agent for or on behalf of the carrier, or [পরিবহনকারী নিজে বা পরিবহনকারীর পক্ষে কোনো নির্দিষ্ট এজেন্ট দ্বারা স্বাক্ষরিত হতে হবে, অথবা]
- the master or a named agent for or on behalf of the master. [জাহাজের মাস্টার (Master) বা তার পক্ষে কোনো নির্দিষ্ট এজেন্ট দ্বারা স্বাক্ষরিত হতে হবে।]
Any signature by the carrier, master or agent must be identified as that of the carrier, master or agent.[পরিবহনকারী, মাস্টার বা এজেন্ট কর্তৃক স্বাক্ষরে স্পষ্টভাবে উল্লেখ থাকতে হবে যে সেটি পরিবহনকারী, মাস্টার বা এজেন্টের স্বাক্ষর।]
Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for or on behalf of the master. [যদি এজেন্ট স্বাক্ষর করে, তবে স্পষ্টভাবে উল্লেখ থাকতে হবে যে সে পরিবহনকারীর পক্ষে নাকি মাস্টারের পক্ষে স্বাক্ষর করেছে।]
ii. indicate that the goods have been dispatched, taken in charge or shipped on board at the place stated in the credit, by: [ এতে উল্লেখ থাকতে হবে যে LC-তে উল্লেখিত স্থানে পণ্যসমূহ dispatched/ taken in charge / shipped on board হয়েছে , যেমন:
- pre-printed wording, or [পূর্বমুদ্রিত বাক্যের মাধ্যমে (লেখা থাকতে পারে), অথবা]
- a stamp or notation indicating the date on which the goods have been dispatched, taken in charge or shipped on board. [স্ট্যাম্প বা নোটেশনের মাধ্যমে, যেখানে dispatched/ taken in charge / shipped on board হয়েছে তার তারিখ উল্লেখ থাকবে।]
The date of issuance of the transport document will be deemed to be the date of dispatch, taking in charge or shipped on board, and the date of shipment. However, if the transport document indicates, by stamp or notation, a date of dispatch, taking in charge or shipped on board, this date will be deemed to be the date of shipment.[পরিবহন দলিলের ইস্যু তারিখ সাধারণত dispatched/ taken in charge / shipped on board এর তারিখ এবং শিপমেন্ট তারিখ হিসেবে গণ্য হবে। তবে যদি স্ট্যাম্প বা নোটেশনের মাধ্যমে dispatched/ taken in charge / shipped on board এর আলাদা কোনো তারিখ উল্লেখ করা থাকে, তাহলে সেই তারিখই শিপমেন্টের তারিখ হিসেবে গণ্য হবে।]
iii. indicate the place of dispatch, taking in charge or shipment and the place of final destination stated in the credit, even if: [ পরিবহন দলিলে এলসি মোতাবেক dispatch/ taking in charge/ shipment এবং place of final destination উল্লেখ থাকতে হবে, এমনকি যদি—]
a. the transport document states, in addition, a different place of dispatch, taking in charge or shipment or place of final destination, [a. পরিবহন দলিলে অতিরিক্তভাবে অন্য কোনো dispatch/ taking in charge/ shipment এবং place of final destination উল্লেখ থাকেও,]
or [অথবা]
b. the transport document contains the indication "intended" or similar qualification in relation to the vessel, port of loading or port of discharge.[b. পরিবহন দলিলে জাহাজ, লোডিং পোর্ট বা ডিসচার্জ পোর্টের ক্ষেত্রে “intended” বা অনুরূপ কোনো শব্দ ব্যবহৃত হলেও ।]
iv. be the sole original transport document or, if issued in more than one original, be the full set as indicated on the transport document. [ transport document এর একটি মাত্র অরিজিনাল ইস্যু হতে; অথবা একাধিক অরিজিনাল ইস্যু করা হতে পারে, সেক্ষেত্রে ডকুমেন্ট বলতে পুরো সেটটিকে বোঝাবে]
v. contain terms and conditions of carriage or make reference to another source containing the terms and conditions of carriage (short form or blank back transport document). Contents of terms and conditions of carriage will not be examined.[ transport document এ পরিবহনের শর্তাবলি (Terms and Conditions of Carriage) থাকতে পারে, অথবা অন্য কোনো উৎস রেফারেন্স হিসেবে থাকতে পারে যেখানে শর্তাবলি পাওয়া যাবে (যেমন Short Form বা Blank Back Transport Document)। এই শর্তাবলির বিষয়বস্তু ব্যাংক পরীক্ষা করবে না।]
vi. contain no indication that it is subject to a charter party. [এতে এমন কোনো উল্লেখ থাকা যাবে না যে পরিবহনটি Charter Party-এর অধীন ।]
b. For the purpose of this article, transhipment means unloading from one means of conveyance and reloading to another means of conveyance (whether or not in different modes of transport) during the carriage from the place of dispatch, taking in charge or shipment to the place of final destination stated in the credit. [ এই আর্টিকেলের উদ্দেশ্যে Transhipment বলতে বোঝায়: পণ্য একটি পরিবহন মাধ্যম থেকে নামিয়ে অন্য একটি পরিবহন মাধ্যমে পুনরায় তোলা, যা প্রেরণ স্থান বা শিপমেন্ট স্থান থেকে ক্রেডিটে উল্লেখিত চূড়ান্ত গন্তব্যস্থলে যাওয়ার পথে ঘটে।]
c. i. A transport document may indicate that the goods will or may be transhipped provided that the entire carriage is covered by one and the same transport document. [ যদি পুরো পরিবহন কার্যক্রম একই transport document দ্বারা কাভার করে তবে transport document এ উল্লেখ থাকতে পারে যে পণ্য transhipment হবে বা হতে পারে ]
ii. A transport document indicating that transhipment will or may take place is acceptable, even if the credit prohibits transhipment. [ transport document এ যদি উল্লেখ থাকে যে transhipment হবে বা হতে পারে, তবুও সেটি গ্রহণযোগ্য হবে, যদিও ক্রেডিটে transhipment নিষিদ্ধ করা থাকে।]

Multimodal Transport: যখন পণ্য একাধিক পরিবহন ব্যবস্থায় (যেমন জাহাজ + ট্রাক + রেল) পরিবহন করা হয়, তখন তাকে Multimodal বা Combined Transport বলা হয়।

Carrier: যে কোম্পানি বা প্রতিষ্ঠান পণ্য পরিবহনের দায়িত্ব গ্রহণ করে।

Master: জাহাজের অধিনায়ক বা ক্যাপ্টেন।

Agent Signature Rule: এজেন্ট স্বাক্ষর করলে অবশ্যই উল্লেখ করতে হবে যে সে Carrier বা Master-এর পক্ষে স্বাক্ষর করছে।

Shipment Date Rule: stamp/notation দিয়ে শিপমেন্সেট তারিখ না থাকলে Transport Document-এর issue date-ই shipment date ধরা হবে।

Place Requirement: LC-তে যে dispatch place এবং final destination উল্লেখ থাকে, transport document-এ তা অবশ্যই হতে হবে।

Original Set Rule: যদি transport document multiple originals-এ ইস্যু হয়, তাহলে সম্পূর্ণ সেট জমা দিতে হবে (যেমন 3/3 originals)।

Terms & Conditions: ব্যাংক পরিবহন শর্তাবলির বিষয়বস্তু পরীক্ষা করে না; তারা শুধু দেখে এটি উল্লেখ আছে কিনা।

Charter Party Restriction: Multimodal transport document সাধারণত charter party contract-এর অধীন হতে পারে না।

Transhipment Rule: Multimodal transport-এ transhipment সাধারণ বিষয়; তাই LC-তে নিষেধ থাকলেও অনেক ক্ষেত্রে তা গ্রহণযোগ্য
