Non-Negotiable Sea Waybill
নন-নেগোশিয়েবল সমুদ্রপরিবহন বিল
a. A non-negotiable sea waybill, however named, must appear to:[যে নামেই ডাকা হোক না কেন, একটি নন-নেগোশিয়েবল সি-ওয়ে বিল -এ নিম্নোক্ত বিষয়গুলো থাকতে হবে:]
i. indicate the name of the carrier and be signed by: [নন-নেগোশিয়েবল সি-ওয়ে বিল-এ carrier (বাহক)-এর নাম থাকতে হবে এবং এটি নিচের নিয়মানুযায়ী স্বাক্ষরিত হতে হবে:]
the carrier or a named agent for or on behalf of the carrier, or
[carrier নিজে অথবা carrier-এর পক্ষে বা তার হয়ে নির্দিষ্ট agent দ্বারা স্বাক্ষরিত হবে; অথবা]the master or a named agent for or on behalf of the master.
[জাহাজের master অথবা master-এর পক্ষে বা তার হয়ে নির্দিষ্ট agent দ্বারা স্বাক্ষরিত হবে।]
Any signature by the carrier, master or agent must be identified as that of the carrier, master or agent. [carrier, master বা agent—যেই স্বাক্ষর করুক না কেন, সেই স্বাক্ষরে স্পষ্টভাবে উল্লেখ থাকতে হবে যে এটি carrier, master অথবা agent-এর স্বাক্ষর।]
Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for or on behalf of the master. [যদি কোনো agent স্বাক্ষর করে, তাহলে উল্লেখ থাকতে হবে যে সে carrier-এর পক্ষে নাকি master-এর পক্ষে স্বাক্ষর করেছে।]
ii. indicate that the goods have been shipped on board a named vessel at the port of loading stated in the credit by:: [এতে উল্লেখ থাকতে হবে যে পণ্য LC-তে উল্লেখিত পোর্ট অব লোডিং (বন্দরে) নির্দিষ্ট জাহাজে তোলা (shipped on board ) হয়েছে। এটা লেখা থাকতে পারে. . . ]
pre-printed wording, or
[প্রিন্ট করা শব্দ দ্বারা; অথবা]an on board notation indicating the date on which the goods have been shipped on board. [একটি “on board” নোটেশনের মাধ্যমে, যেখানে পণ্য জাহাজে তোলা(shipped on board)র তারিখ উল্লেখ থাকবে।]
The date of issuance of the non-negotiable sea waybill will be deemed to be the date of shipment unless the non-negotiable sea waybill contains an on board notation indicating the date of shipment, in which case the date stated in the on board notation will be deemed to be the date of shipment.

If the non-negotiable sea waybill contains the indication “intended vessel” or similar qualification in relation to the name of the vessel, an on board notation indicating the date of shipment and the name of the actual vessel is required. [যদি সিওয়ে বিল -এ জাহাজের নামের ক্ষেত্রে “intended vessel” বা অনুরূপ শব্দ থাকে, তাহলে একটি on board notation থাকতে হবে যেখানে প্রকৃত জাহাজের নাম এবং shipment-এর তারিখ উল্লেখ থাকবে।]

iii. indicate shipment from the port of loading to the port of discharge stated in the credit. [এতে উল্লেখ থাকতে হবে যে পণ্য LC-এ উল্লিখিত port of loading (বন্দর) থেকে port of discharge (বন্দরে) পাঠানো হয়েছে।]
If the Non-negotiable sea waybill does not indicate the port of loading stated in the credit as the port of loading, or if it contains the indication “intended” or similar qualification in relation to the port of loading, an on board notation indicating the port of loading as stated in the credit, the date of shipment and the name of the vessel is required.
[যদি Non Negotiable Sea WayBill -এ LC-তে বর্ণিত port of loading বন্দর স্পষ্টভাবে উল্লেখ না থাকে, অথবা port of loading-এর ক্ষেত্রে “intended” বা অনুরূপ শব্দ থাকে, তাহলে একটি on board notation থাকতে হবে যেখানে LC-এ উল্লেখিত port of loading, shipment date এবং জাহাজের নাম উল্লেখ থাকবে।]
This provision applies even when loading on board or shipment on a named vessel is indicated by pre-printed wording on the Non Negotiable Sea Waybill. [Non Negotiable Sea Waybill-এ pre-printed শব্দদ্বারা বোর্ডে লোডিং বা নির্দিষ্ট জাহাজে shipment উল্লেখ থাকলেও এই বিধান প্রযোজ্য হবে।]
iv. be the sole original Non Negotiable Sea Waybill or, if issued in more than one original, be the full set as indicated on the Non Negotiable Sea Waybill. [Non Negotiable Sea Waybill এর একটি মাত্র অরিজিনাল ইস্যু হতে পারে; অথবা একাধিক অরিজিনালও ইস্যু করা হতে পারে, সেক্ষেত্রে ডকুমেন্ট বলতে পুরো সেটটিকে বোঝাবে।]
v. contain terms and conditions of carriage or make reference to another source containing the terms and conditions of carriage (short form or blank back Non Negotiable Sea Waybill). [Non Negotiable Sea Waybill এ পরিবহণ-এর শর্তাবলি লেখা থাকতে হবে অথবা এমন কোনো উৎসের উল্লেখ থাকতে হবে যেখানে এই শর্তাবলি রয়েছে (যেমন short form বা blank back Non Negotiable Sea Waybill)।]
Contents of terms and conditions of carriage will not be examined.
[এই carriage terms and conditions-এর বিষয়বস্তু পরীক্ষা করা হবে না।]
vi. contain no indication that it is subject to a charter party.
[বিএলটি charter party-এর অধীন, এমন কিছুর উল্লেখ থাকা যাবে না।]
b. For the purpose of this article, transhipment means unloading from one vessel and reloading to another vessel during the carriage from the port of loading to the port of discharge stated in the credit.
[এই অনুচ্ছেদের উদ্দেশ্যে transhipment বলতে বোঝায়—port of loading বন্দর থেকে port of discharge বন্দর পর্যন্ত পরিবহনের সময় একটি জাহাজ থেকে পণ্য নামিয়ে অন্য জাহাজে পুনরায় তোলা।]
c. i. A Non Negotiable Sea Waybill may indicate that the goods will or may be transhipped provided that the entire carriage is covered by one and the same Non Negotiable Sea Waybill. [যদি পুরো পরিবহন একই Non Negotiable Sea Waybill দ্বারা কাভার করা থাকে, তবে Non Negotiable Sea Waybill-এ উল্লেখ থাকতে পারে যে পণ্য transhipment হবে বা হতে পারে ।]
ii. A Non Negotiable Sea Waybill indicating that transhipment will or may take place is acceptable, even if the credit prohibits transhipment, if the goods have been shipped in a container, trailer or LASH barge as evidenced by the Non Negotiable Sea Waybill. [Non Negotiable Sea Waybill-এ transhipment হবে বা হতে পারে উল্লেখ থাকলেও তা গ্রহণযোগ্য হবে। এমনকি যদি LC-তে transhipment নিষিদ্ধ থাকলেও যদি Non Negotiable Sea Waybill থেকে প্রমাণে মেলে যে পণ্য container, trailer বা LASH barge-এ পরিবহন করা হয়েছে, তাও গ্রহণযোগ্য হবে।]
d. Clauses in a Non Negotiable Sea Waybill stating that the carrier reserves the right to tranship will be disregarded. [Non Negotiable Sea Waybill -এ যদি উল্লেখ থাকে যে carrier প্রয়োজনে transhipment করার অধিকার সংরক্ষণ করে, তাহলে সেই ধারা বিবেচনাযোগ্য হবে না।]
টীকা : Article 20 (Bill of Lading) ও Article 21 (Non-Negotiable Sea Waybill) তুলনা করলে দেখা যায়, মূল পাঠ্যগত পার্থক্য শুধু এই দুটি শব্দের মধ্যে: Article 20: “bill of lading” ও Article 21: “non-negotiable sea waybill”
১. Carrier Signature Rule : সিওয়ে বিল অবশ্যই স্বাক্ষরিত হবে:

অথবা তাদের agent (Agent হলে অবশ্যই উল্লেখ থাকবে: “as agent for the carrier” বা “as agent for the master” লিখতে হবে)
২. Shipment Date Determination
On board notation না থাকলে → BL issue date = shipment date
On board notation থাকলে → on board date = shipment date
৩. Intended Vessel Problem: সিওয়ে বিল-এ যদি লেখা থাকে “intended vessel”, তাহলে বাধ্যতামূলক থাকতে হবে:
actual vessel name
shipment date সহ on board notation
৪. Full Set Requirement
LC যদি বলে Full set of original BL, তাহলে BL-এ যেমন লেখা থাকে (e.g., 3/3 originals) সবগুলো জমা দিতে হবে।
৫. Charter Party Restriction
Article 20-এর BL charter party BL হতে পারবে না।
Charter party BL হলে তা Article 22-এর অধীনে পড়বে।
৬. Transshipment Trap (Exam Favourite)
LC transshipment নিষিদ্ধ করলেও BL গ্রহণযোগ্য যদি:

৭. Carrier Right Clause
BL-এ যদি লেখা থাকে
“Carrier reserves the right to tranship”
