Partial Drawings or Shipments
পার্শিয়াল ড্রয়িং বা পার্শিয়াল শিপমেন্ট
31 (a) Partial drawings or shipments are allowed. [ আংশিক ড্রয়িং (টাকা উত্তোলন) বা আংশিক শিপমেন্ট (পণ্য প্রেরণ) অনুমোদিত।
(ব্যাখ্যা: এলসিতে যদি আলাদাভাবে নিষেধ করা না থাকে, তবে আংশিক শিপমেন্ট করা যাবে। যদিও আধুনিক সুইফট সিস্টেমে allowed/Not allowed দেয়া বাধ্যমূলক। তাই এই ধারা খুব একটা কাজের নয়। তবে সুইফট সিস্টেমের বাইরে কুরিয়ার বা রিটেন এলসির বিষয় এটা গুরুত্বপূর্ন হয়ে উঠে )।]
31 (b) A presentation consisting of more than one set of transport documents evidencing shipment commencing on the same means of conveyance and for the same journey, provided they indicate the same destination, will not be regarded as covering a partial shipment, even if they indicate different dates of shipment or different ports of loading, places of taking in charge or dispatch. If the presentation consists of more than one set of transport documents, the latest date of shipment as evidenced on any of the sets of transport documents will be regarded as the date of shipment. A presentation consisting of one or more sets of transport documents evidencing shipment on more than one means of conveyance within the same mode of transport will be regarded as covering a partial shipment, even if the means of conveyance leave on the same day for the same destination. [তবে, একই দিনে একই গন্তব্যের উদ্দেশ্যে রওনা দিলেও যদি একাধিক পরিবহনে (যেমন: দুটি আলাদা জাহাজ বা দুটি আলাদা ট্রাক) পণ্য পাঠানো হয়, তবে তাকে আংশিক শিপমেন্ট হিসেবে গণ্য করা হবে।]
31 (c) A presentation consisting of more than one courier receipt, post receipt or certificate of posting will not be regarded as a partial shipment if the courier receipts, post receipts or certificates of posting appear to have been stamped or signed by the same courier or postal service at the same place and date and for the same destination. [ একের অধিক কুরিয়ার রসিদ বা ডাক রসিদ জমা দেওয়া হলে তাকে আংশিক শিপমেন্ট বলা হবে না, যদি সেগুলো একই স্থানে, একই তারিখে, একই কুরিয়ার বা ডাক বিভাগ কর্তৃক স্বাক্ষরিত/সিলযুক্ত হয় এবং গন্তব্য একই থাকে।]
টীকা ও ব্যাখ্যা:
১. ডিফল্ট নিয়ম: মনে রাখবেন, এলসি যদি নীরব থাকে তবে আংশিক শিপমেন্ট অনুমোদিত। এটি বন্ধ করতে হলে এলসিতে স্পষ্টভাবে "Partial Shipment: Prohibited" লিখতে হবে।
২. একই জাহাজ বনাম ভিন্ন জাহাজ: এটিই এই আর্টিকেলের সবচেয়ে গুরুত্বপূর্ণ পয়েন্ট।
একই জাহাজ (Same Vessel): আপনি চট্টগ্রাম থেকে ৫০০ টন মালামাল নিলেন ৫ তারিখে, আবার মংলা থেকে ওই একই জাহাজে ৫০০ টন নিলেন ৭ তারিখে। এটি আংশিক শিপমেন্ট নয়। এখানে শিপমেন্টের তারিখ হবে ৭ তারিখ।
ভিন্ন জাহাজ (Different Vessel): একই দিনে দুটি আলাদা জাহাজে করে মালামাল পাঠালেন। এটি আংশিক শিপমেন্ট।
৩. শিপমেন্টের তারিখ নির্ধারণ: একাধিক বিএল (Bill of Lading) থাকলে ব্যাংক সবসময় সবচেয়ে শেষের তারিখটিকে (Latest Date) পুরো চালানের শিপমেন্ট তারিখ হিসেবে ধরবে। ম্যাচুরিটি ডেট বা প্রেজেন্টেশন পিরিয়ড গণনার ক্ষেত্রে এটি খুব গুরুত্বপূর্ণ।
৪. কুরিয়ার/পোস্টাল: কুরিয়ারের ক্ষেত্রে একই দিন এবং একই জায়গা থেকে হতে হবে। কিন্তু জাহাজের ক্ষেত্রে জায়গা ভিন্ন হলেও (যেমন: দুটি আলাদা বন্দর) একই জাহাজ হলে ছাড় পাওয়া যায়।
