Original Documents and Copies
অরিজিনাল ডকুমেন্ট ও কপি
a. At least one original of each document stipulated in the credit must be presented [ (ক) এলসিতে বর্ণিত ডকুমেন্ট লিস্টে এর কমপক্ষে একসেট অরিজিনাল উপস্থাপন করতে হবে। ]
b. A bank shall treat as an original any document bearing an apparently original signature, mark, stamp, or label of the issuer of the document, unless the document itself indicates that it is not an original [(খ) যদি কোনো ডকুমেন্টে ইস্যুয়ারের আপাতদৃষ্টিতে মূল স্বাক্ষর, চিহ্ন, স্ট্যাম্প বা লেবেল থাকে এবং দলিলটিতে এমন কোনো উল্লেখ না থাকে যা থেকে বোঝা যায় যে এটি মূল নয়, তবে ব্যাংক সেই ডকুমেন্টকে অরিজিনাল ডকুমেন্ট হিসেবে গণ্য করবে।
c. Unless a document indicates otherwise, a bank will also accept a document as original if it:
i. appears to be written, typed, perforated or stamped by the document issuer's hand; or
ii.
appears to be on the document issuer's original stationery; or iii. states that
it is original, unless the statement appears not to apply to the document
presented.[ (গ) কোনো ডকুমেন্টে ভিন্নকিছু না থাকলে, নিম্নোক্ত অবস্থায় ব্যাংক একটি ডকুমেন্টকে অরিজিনাল হিসেবে গ্রহণ করবে—
i. যদি তা ডকুমেন্টের ইস্যুয়ার কর্তৃক লিখিত, টাইপকৃত, ছিদ্রকৃত (perforated) বা স্ট্যাম্পকৃত বলে প্রতীয়মান হয়; অথবা
ii. যদি তা ডকুমেন্টের ইস্যুয়ারের মূল অফিসিয়াল প্যাডে (stationery) প্রস্তুত বলে প্রতীয়মান হয়; অথবা
iii. যদি তাতে উল্লেখ থাকে যে এটি অরিজিনাল। তবে শর্ত থাকে যে উক্ত ”অরিজিনাল শব্দটি’ উপস্থাপিত ডকুমেন্টের ক্ষেত্রে প্রযোজ্য বলে প্রতীয়মান হতে হবে।]
d. If a credit requires presentation of copies of documents, presentation of either originals or copies is permitted.[ ঘ) এলসিতে যদি দলিলাদির কপি উপস্থাপনের শর্ত থাকে, তাহলে সেক্ষেত্রে মূল দলিলাদি অথবা তার কপি—যেকোনোটি উপস্থাপন করা যাবে।]
e. If a credit requires presentation of multiple documents by using terms such as "in duplicate", "in two fold" or "in two copies", this will be satisfied by the presentation of at least one original and the remaining number in copies, except when the document itself indicates otherwise.[ (ঙ) এলসিতে যদি “in duplicate”, “in two fold” বা “in two copies” ইত্যাদি শব্দ ব্যবহার করে একাধিক ডকুমেন্ট উপস্থাপনের শর্ত আরোপ করা হয়, তাহলে কমপক্ষে একটি মূল দলিলাদি + অবশিষ্টগুলো কপি হিসেবে উপস্থাপন করলেই হবে তবে দলিলাদিতে নিজেই ভিন্ন কিছু উল্লেখ থাকলে তা প্রযোজ্য হবে।]
