Air Transport Doccument
বিমান পরিবহন ডকুমেন্ট
a.An air transport document, however named, must appear to:[যে নামেই ডাকা হোক না কেন, একটি Air Transport Document-এ নিম্নোক্ত বিষয়গুলো থাকতে হবে :]
indicate the name of the carrier and be signed by: [ Air way bill এ carrier (বাহক)-এর নাম থাকতে হবে এবং এটি স্বাক্ষরিত হতে হবে:]
the carrier, or
[carrier নিজে; অথবা]-
a named agent for or on behalf of the carrier.
[carrier-এর পক্ষে বা তার হয়ে কোনো নির্দিষ্ট agent দ্বারা স্বাক্ষরিত হবে।]
Any signature by the carrier or agent must be identified as that of the carrier or agent.
[carrier বা agent যে স্বাক্ষরই করুক না কেন, সেটি স্পষ্টভাবে উল্লেখ থাকতে হবে যে এটি carrier বা agent-এর স্বাক্ষর।]
Any signature by an agent must indicate that the agent has signed for or on behalf of the carrier.
[যদি agent স্বাক্ষর করে, তাহলে উল্লেখ থাকতে হবে যে সে carrier-এর পক্ষে বা তার হয়ে স্বাক্ষর করেছে।]
ii.indicate that the goods have been accepted for carriage. [এতে উল্লেখ থাকতে হবে যে পরিবহনের জন্য পণ্য গ্রহণ করা হয়েছে।]
iii.indicate the date of issuance. This date will be deemed to be the date of shipment unless the air transport document contains a specific notation of the actual date of shipment, in which case the date stated in the notation will be deemed to be the date of shipment.[এতে issue date উল্লেখ থাকতে হবে। Air Transport Document-এ প্রকৃত shipment date-এর একটি নির্দিষ্ট notation যদি না থাকে তবে এই তারিখকে shipment date হিসেবে ধরা হবে। যদি এমন notation থাকে, তাহলে সেই notation-এ উল্লেখিত তারিখকেই shipment date হিসেবে গণ্য করা হবে।]
iv.indicate the airport of departure and the airport of destination stated in the credit
[এতে LC-তে উল্লেখিত airport of departure এবং airport of destination থাকতে হবে।]
v.be the original for consignor or shipper, even if the credit stipulates a full set of originals.[এটি consignor বা shipper-এর জন্য নির্ধারিত original কপি হতে হবে, এমনকি যদি LC-তে full set of originals চাওয়া হয়।]
vi.contain terms and conditions of carriage or make reference to another source containing the terms and conditions of carriage. Contents of terms and conditions of carriage will not be examined.[এতে carriage-এর শর্তাবলি থাকতে হবে অথবা এমন কোনো উৎসের উল্লেখ থাকতে হবে যেখানে এই শর্তাবলি রয়েছে। তবে carriage-এর শর্তাবলির বিষয়বস্তু ব্যাংক পরীক্ষা করবে না।]
b.For the purpose of this article, transhipment means unloading from one aircraft and reloading to another aircraft during the carriage from the airport of departure to the airport of destination stated in the credit.[এই অনুচ্ছেদের উদ্দেশ্যে transhipment বলতে বোঝায়—departure airport থেকে destination airport পর্যন্ত পরিবহনের সময় একটি aircraft থেকে পণ্য নামিয়ে অন্য aircraft-এ পুনরায় তোলা।]
c.i.An air transport document may indicate that the goods will or may be transhipped, provided that the entire carriage is covered by one and the same air transport document. [যদি সম্পূর্ণ পরিবহন একই Air Transport Document দ্বারা কাভার করা থাকে, Air Transport Document-এ উল্লেখ থাকতে পারে যে পণ্য transhipment হবে বা হতে পারে, ।]
ii.An air transport document indicating that transhipment will or may take place is acceptable, even if the credit prohibits transhipment.[এমনকি যদি LC-তে transhipment নিষিদ্ধও থাকে তবু Air Transport Document-এ transhipment হবে বা হতে পারে উল্লেখ থাকলে তাও গ্রহণযোগ্য হবে ।]
টীকা
1️⃣ Shipment Date Rule (Exam Trap) Air transport document-এ: Issue date = shipment date। যদি actual shipment date notation থাকে → সেই তারিখই shipment date। ⚠ Flight date দেখে shipment date নির্ধারণ করা যাবে না।
2️⃣ Sea document-এর মতো “Shipped on board” নয়। Air document-এ লেখা থাকে: “Goods accepted for carriage”
3️⃣ Original Requirement (বড় Exam Trap)
Sea BL-এ → full set of originals
Air transport document-এ →
✔ শুধু Original for Shipper/Consignor
LC full set চাইলে তাও একটাই acceptable।
4️⃣ Transshipment Rule । Air transport-এ: ✔ Transshipment allowed ✔ LC prohibit করলেও acceptable
5️⃣ Signature Rule
Sign করতে পারে: Carrier বা Carrier-এর agent [ Master / owner / charterer নেই (sea transport-এর মতো না)।]
